Privacy Policy

APG & Co PTY limited ABN: 36 155 404 826 (referred to as “JAG”, “We”, “Our” and “Us”) recognises that the privacy of your personal information is important to you. Unless you directly give us consent to do otherwise, we will only collect and use your personal information as set out below. JAG abides by the “Australian Privacy Principles” contained in the privacy act 1988.

This Privacy Policy outlines how JAG will handle and manage personal information we collect about you. As we collect personal information in-store at our JAG stores, including clearance stores, and online through www.jag.com.au (our website), this privacy policy also applies to your use of the JAG website. By providing your personal information to us and by using our website, you consent to the collection of your personal information by JAG and its use and disclosure in accordance with this privacy policy.

We may collect certain types of personal information from you. Personal information is any information that can be used to identify you and may include details such as name, address, telephone numbers (including your mobile phone number), date of birth, gender, occupation and email address. We also collect transaction details relating to your purchases from us and any preferences you select as well as other personal information you disclose to us in communications between us and you.

Generally, we collect personal information about customers and members to provide a range of products and services, to meet our obligations to you and to enable us to conduct our business. We also collect personal information so you can enter a competition, receive our newsletter and other promotional material, seek employment or communicate with JAG by e-mail, telephone or writing. We collect personal information from members so they can receive style updates, exclusive offers and promotions, pre-sale event invitations and personalised offers based on their shopping preferences. JAG members may also rate and review our products on our website. If you do not supply requested personal information, we may be delayed or prevented from finalising your purchase or satisfying your request or enquiry. You will not be able to join the JAG member program and enjoy all the benefits of the JAG program if you do not provide all requested personal information.

We may collect personal information in a number of ways including: when you join the JAG member program; when you contact us with an enquiry; when you submit a job application; through our website or our mobile site when you: place an online order with us enter a competition rate and review a JAG product otherwise access and/or use our website; and through any social media platform upon which you engage with us. Generally, personal information is collected directly from you at the time you make a purchase, register as a JAG member through our website or when you have other dealings with us. If you make a purchase through our website, we collect and store personal information associated with your purchase, including the details you provide at checkout – such as your name, contact details, and delivery and billing addresses where applicable – and your transaction details. This information is stored in the systems used by us or on our behalf to operate our website and process your purchase, including in a customer profile on our e-commerce platform. This applies to every purchase through our website. If you use guest checkout, you do not create or activate an online account, but we still collect and store the information described above, and a customer profile associated with your purchase is created or updated and retained in those systems. In some instances we may collect personal information about you from someone else. For example, someone may give us your name and address if they have purchased a JAG gift for you and wish us to deliver the gift to you. If you provide us with personal information of another individual you agree to take reasonable steps to ensure that the individual is made aware of the matters set out in this privacy policy. Also, we make use of “Cookies” on our websites, which may collect personal information. A cookie is a small software message sent to your web browser by our web server. Your browser stores the message in a file and the message is then sent back to our servers each time your browser requests a page from our servers. We use cookies to gain statistics on which areas of our sites attract traffic. We also use cookies to improve your experience of our websites. For example, cookies allow us to recognise whether or not you are returning to our websites. In addition, we make use of third parties who use cookies to serve ads based on past visits to our website. This may allow us to alert you to products or offers which we think you might be interested in viewing. Most internet browsers are set up to accept cookies. If you do not wish to receive cookies, you will need to adjust the settings of your browser to refuse all cookies or to notify you each time a cookie is sent to your computer. You might not be able to use the full functionality of the JAG website by refusing the use of cookies. When you click on links and banners on our sites that take you to third-party websites, you will be subject to that third-party's privacy policies. While we support the protection of privacy on the internet, we cannot be held responsible for the actions of any third-party websites.

We collect your personal information customise our services and to keep you up to date with any important changes to our website including our products and services, to notify you of special events, promotions and offers that may be of interest to you (including by mail, email and sms), to send you our newsletter, to respond to your queries and to help JAG manage and enhance its products and services. We also collect your personal information to allow us to manage and fulfil any orders you place with us including delivering any gifts purchased by you. We will also use personal information to deal with enquiries, requests and other communications. This will include any job application submitted to us, competition entries and any product complaints and enquiries.

JAG does not sell or trade your personal information gathered online with third parties for their marketing purposes without your consent. JAG may however disclose your personal information to: service providers or persons who perform functions on our behalf, for example, providers that host, operate or support our website and e-commerce functions and store customer and order information, mailing services, distribution services, it services, data analysis, research, advertising or consultancy services; organisations who are involved in a competition run by JAG; law enforcement agencies in relation to a suspected breach of any law; our professional advisers; regulatory authorities; anyone else to whom you authorise us to disclose it. Disclosures to service providers, and their handling of personal information, are subject to applicable privacy laws and the relevant contractual arrangements. JAG may from time to time publish information on our website or mobile site about certain members. However, this information will be limited to the member’s first name and/or surname, gender, and city or state of residence and the gender of the member. Where we conduct competitions on our website, our mobile site or through social media, the terms and conditions of the competition will include their own privacy provisions.
Our online store is hosted by Shopify. Shopify collects and processes personal information when you visit or make a purchase through our online store, including to provide services to us and to you. Information submitted to or generated through our online store is shared with Shopify and with other service providers, some of which may be located overseas. Depending on the services, features and settings used in connection with our online store, Shopify may process personal information for purposes such as checkout and payment processing, order management and fulfilment, customer support, security and fraud prevention, analytics, personalisation, advertising and other enhanced services. Where Shopify network intelligence is enabled, this may include processing information from your interactions with our online store together with information from your interactions with other merchants and with Shopify.
Shopify and those other providers may process personal information in Australia and overseas, including in the countries identified in Shopify’s current list of subprocessors (available at help.shopify.com/en/manual/privacy-and-security/privacy/subprocessors). Further information about how Shopify handles personal information, and the privacy choices available to you (including how you may object to or opt out of certain processing by Shopify), is available in Shopify’s consumer privacy policy (www.shopify.com/legal/privacy/consumers) and Shopify’s privacy portal (privacy.shopify.com).

Some of JAG’s third party contractors and service providers may perform certain services overseas and as a result your personal information may be disclosed to a recipient in a foreign country. For example, we may use a server hosted overseas to store data including your personal information or send emails to JAG customers. Where we disclose personal information to an overseas recipient, we will comply with the requirements of the privacy act that apply to that disclosure, including taking reasonable steps, where required, to ensure that the overseas recipient does not breach the Australian privacy principles in relation to that information.

At JAG we want to communicate with you only if you want to hear from us. If you prefer not to receive promotional information from us or if you do not want your information used to enhance your shopping experience, please let us know by clicking on the unsubscribe link at the bottom of any of our communications, please allow up to 48hrs for unsubscribe to be actioned.

Any information that we no longer require is destroyed securely. An exception to this may be retention of the information for data analysis. However, if this occurs, the information will be retained in a form that does not allow you to be identified from that information. We retain personal information for as long as it is needed for a purpose for which it may be used or disclosed under the privacy act, or as required by or under an Australian law or a court or tribunal order. If you make a purchase through our website (including using guest checkout), your details will remain stored in our systems after your purchase is completed.
You may contact us at any time, using the contact details set out below, to request the closure or deletion of your online account (if any) and the deletion or erasure of personal information associated with your customer profile (including a customer profile associated with a guest checkout). We may need to verify your identity before actioning your request. Subject to the retention requirements described above, we will take reasonable steps to delete, erase or de-identify that personal information.
A customer profile associated with an order, and certain order and transaction records, may not be capable of deletion from our e-commerce platform. Where those records remain, we will take reasonable steps to erase or de-identify the personal information associated with them that we no longer need for a purpose permitted under the privacy act. If you use Shopify’s own services, such as shop or shop pay, Shopify may hold personal information through your separate relationship with Shopify – a deletion request made to us does not cover that information, and you can contact Shopify about it through Shopify’s privacy portal (privacy.shopify.com).

Under the privacy act, you have a right to seek access to information which JAG holds about you. You also have the right to ask us to correct information about you which is inaccurate, incomplete or out of date. While JAG takes all reasonable precautions to ensure that your personal information is complete and up to date, please notify us of any changes or errors in your personal information held by us. If you are a JAG member, you may access, review and update your personal information by simply logging into our website using ‘log in’. Alternatively you can call 1800 993 946 from Australia only. If you are not a JAG member, you may access the information JAG holds about you by placing your request in writing and sending it to us using the contact details below. We will comply with any such request except where the privacy act allows us to refuse to do so.

We take all reasonable steps to maintain the security and integrity of your personal information and to protect your personal information from misuse, interference and loss and unauthorised access, modification or disclosure.

Protecting your personal and order information is a priority at JAG and we take all reasonable measures to do so. As such we use secure sockets layer (SSL) technology – our on-line ordering system is the industry standard for encryption technology; to protect your online order information. SSL encrypts all information including your credit card and all personal information passed from you to www.jag.com.au. Encryption provides you with security and peace of mind when your browser and local network supports the use of encrypted data transmissions. However, we suggest that you take appropriate security precautions when you access the internet via public wi-fi networks or shared computers.

Any complaints notified to us will be considered within 21 days and responded to. We will always endeavour to resolve any complaint to your satisfaction.
